TERMS OF SERVICE

1. Agreement

By accessing or using edukaji.my or signing up for any EduKaji programme, you agree to be bound by these Terms of Service and our Privacy & Data Protection Policy below (each as amended from time to time). If you do not agree, please do not use the website or our programmes.

If you are under 18, you confirm that a parent or guardian has reviewed these Terms and agrees to them on your behalf.

2. The Service

EduKaji provides free online SPM exam preparation resources and classes, including trial papers, videos, timetables, and structured programmes, delivered through the platform of our choice. EduKaji does not currently offer any paid programmes, content, or subscriptions — all access described in these Terms is provided free of charge.

3. Eligibility

There is no minimum age to browse edukaji.my. To register for a programme or account, you (or, if you are under 18, your parent or guardian) must be able to enter into these Terms. By signing up, you confirm this requirement is met.

4. Your Account

  • You are responsible for keeping your login credentials confidential and for all activity under your account.
  • Provide accurate information when registering, and keep it up to date.
  • You may not share your account access with unauthorised users. We are not responsible for any adverse consequences arising from unauthorised sharing of your account.
  • Notify us at info@edukaji.my if you suspect unauthorised use of your account.

5. Acceptable Use

You agree to use the website and access to content and classes only for lawful purposes, and not in a way that damages EduKaji or our partners reputationally or financially.

You agree not to:

  • Use any robot, spider, scraper, or other automated means to access the classes or website, or to monitor or copy our web pages or content, without our prior written permission.
  • Use any device, software, or routine that interferes with the proper working of our online classes or systems, or attempt to do so.
  • Attempt to bypass access controls or security measures.
  • Distribute, commercialise, or share your account access or class materials with unauthorised users.

Enforcement: We reserve the right to investigate violations, suspend or remove your access to the Programme, and take legal action to recoup any damages arising from a breach of these Terms.

6. Intellectual Property

Your access to live or recorded classes, and any digital or hardcopy materials you receive, is granted solely for your personal use in following your lessons. All such resources — and the right to broadcast or distribute them — remain the legal property of Uni Enrol Sdn Bhd ("the Company"). You may not duplicate, distribute, or commercialise them in any form outside your own personal consumption.

While you are registered for a programme, you are granted a right to access and use the resources within the authorised period, but you do not acquire ownership of any underlying intellectual property (including the system, class materials, and class content).

7. Delivery of Classes and Materials

  • Classes are delivered online only, through the platform of our choice. You will receive access to available classes upon registration.
  • Where class materials are provided in hardcopy, they will be couriered to you within 5 to 10 working days of your registration, subject to availability.

8. Gifts and Promotional Codes

We or our partners may from time to time offer gifts or promotional codes to students, which may take the form of physical or digital items, or promotional credits, subject to their respective terms and conditions. Such gifts and codes may expire if not redeemed within the specified period and are not redeemable for cash unless explicitly stated.

9. Free Service — No Service Level Guarantee

EduKaji's programmes are provided free of charge, on a best-effort basis. We do not guarantee uninterrupted access, specific feature availability, or any particular outcome from participation in our programmes.

  • We may modify, suspend, rate-limit, or discontinue any part of the Programme at our discretion, with reasonable notice where practicable.
  • We are not responsible if you are unable to attend classes, and we are not responsible for your exam outcomes if you do not put in the effort and time required to achieve your desired results.

10. Programme Changes and Cancellation

We reserve the right to modify or cancel a programme by giving notice in writing (including by email) at any time. Where a programme you have registered for is cancelled, we will, where possible, endeavour to offer you access to an alternative programme or class.

11. Termination

We may remove or suspend your access to the Programme if you are found to have violated these Terms. You may stop using the Programme and request account deletion at any time by contacting us at info@edukaji.my. Provisions of these Terms that by their nature should survive termination (including Intellectual Property, Disclaimer of Warranties, and Limitation of Liability) will continue to apply.

12. Disclaimer of Warranties

The service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the website or classes will be uninterrupted, error-free, or secure, or that any particular exam result will follow from your participation.

13. Limitation of Liability

To the maximum extent permitted by law, EduKaji and Uni Enrol Sdn Bhd will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the website or programmes.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In those jurisdictions, our liability is limited to the maximum extent permitted by law, and the above limitations may not apply to you.

14. Governing Law & Venue

These Terms are governed by the laws of Malaysia, without regard to conflict-of-law principles. Any disputes arising out of or relating to these Terms will be subject to the exclusive jurisdiction of the courts of Malaysia.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted here with a new "Last updated" date. Your continued use of EduKaji after changes are posted constitutes acceptance of the revised Terms.

PRIVACY & DATA PROTECTION POLICY

1. Who We Are

EduKaji is an online learning platform operated by Uni Enrol Sdn Bhd (1242078-V), B-03-08, Sunway Geo Avenue, Jalan Lagoon Selatan, Bandar Sunway, 47500 Subang Jaya, Selangor, Malaysia. For any privacy-related questions, contact us at info@edukaji.my.

2. What EduKaji Does

EduKaji provides free online SPM exam preparation resources, including trial papers, videos, timetables, and structured classes, to help secondary school students prepare for the SPM examination. No payment is required to access our programmes.

3. Information We Collect

What we don't collect: If you are only browsing the website, you remain anonymous — we do not collect personal information from casual browsing, and we do not collect any payment information, since EduKaji does not currently offer paid content.

Information you provide: When you register for a programme, trial class, or a gift/promotional code, we may collect personal information such as your name, phone number, and email address, and any other information you voluntarily submit through a registration or application form.

Analytics data: We collect aggregated, de-identified usage data through Google Analytics, including page views, referral source, and average time spent on the site.

4. How We Collect Data

We collect personal information only when you choose to register for a programme or trial class, accept a gift or promotional code with conditions, or otherwise voluntarily submit information via a form on our website. By submitting personal information, you confirm that it is accurate and does not infringe the rights of any third party.

5. How We Use Your Information

With your consent, we may use your information to:

  • Send you our newsletter and information about programmes we think may interest you.
  • Enable your access to and use of our programmes.
  • Personalise and improve our services, including analysing usage trends and demographics.
  • Communicate with you to verify your information or request additional details needed to provide the service you registered for.
  • Administer contests, promotions, campaigns, polls, or surveys you participate in.
  • Detect, investigate, and prevent fraudulent, prohibited, or illegal activity or misuse of the service.

6. Cookies

A cookie is a very small text file placed on your computer. Cookies help us to:

  • Understand browsing habits on this website.
  • Understand the number of visitors to this website and the pages visited.
  • Remember you when you return to this website so we can provide you with a better browsing experience.

Most cookies are deleted as soon as you close your browser, these are known as session cookies. Others, known as persistent cookies, are stored on your computer either until you delete them or they expire. By using our website, you consent to us using cookies.

  • Analytics cookie allows us to see information on user website activity including, but not limited to page views, referral and average time spent on the website. The information is de-personalised and is displayed as numbers, meaning it will not be tracked back to individuals, which helps to protect your privacy. Using analytics we can see what content is popular on our website, and strive to ensure you have the best user experience possible.
  • We use Analytics remarketing codes to log when users view specific pages or take specific actions on the website. This allows us to provide targeted advertising in the future.

You can choose to block or delete cookies through your browser settings. If you decide to block or delete our cookies, you will not be able to benefit from the full range of our services and this may affect the performance of our website on your system.

7. Sharing Your Information

We may share your personal data with our partners and sponsors where you have signed up for a free programme or redeemed a gift or promotional benefit offered in conjunction with that partner or sponsor. We will not sell, rent, or lease your personal information to any other third party, and will not otherwise share it, unless we have your permission or are required to do so by law.

8. Third-Party Services

If you decide to enter into a contract with a third party provider through us, the information you have provided to us together with any further information requested by, and supplied by you or us to the third party provider will be held by the provider for the purposes set out in that provider's privacy policy. Therefore, you are strongly advised to read your chosen provider's privacy policy and satisfy yourself as to the purposes for which the provider will use your personal information before entering into the contract. We have no responsibility for the uses to which a provider puts your personal information.

9. Data Retention

We retain personal information only for as long as needed to fulfil the purposes described in this Policy:

  • Registration data (name, phone, email): retained while your account is active, and deleted within a reasonable period after account deletion or once no longer needed, unless a longer period is required by law.
  • Analytics data: retained per Google Analytics' standard retention settings.
  • We take reasonable technical and organisational measures to protect your data against loss, misuse, unauthorised access, alteration, or destruction.

10. Your Rights

Under Malaysia's Personal Data Protection Act 2010 (PDPA), you have the right to:

  • Access the personal data we hold about you.
  • Request correction of inaccurate data.
  • Withdraw consent to our processing of your data for a given purpose (including marketing).
  • Request deletion of your data, subject to any legal retention requirements.

If you are contacting us from outside Malaysia and believe additional data protection rights apply to you under your local law, please let us know and we will do our best to accommodate your request.

11. Marketing Communications

By providing your personal information, you consent to us contacting you by email, post, telephone, or text about programmes and offers we think may interest you, unless you tell us otherwise at the time you provide your information. Every marketing email includes clear unsubscribe instructions. You may also opt out at any time by emailing info@edukaji.my.

12. Children's Privacy

Many of our users are secondary school students preparing for SPM, some of whom may be under 18. Where a user is a minor, we expect registration to be carried out with the knowledge and consent of a parent or guardian. Parents or guardians may contact us at info@edukaji.my to review, correct, or request deletion of their child's information.

13. Security

We use reasonable technical and organisational safeguards, including access controls, to protect your personal data. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

We may update this Policy from time to time. Material changes will be posted here with a new "Last updated" date. Your continued use of EduKaji after changes are posted constitutes acceptance of the revised Policy.
